PRIVACY POLICY

1. An overview of data protection

General information

The following notes provide a simple overview of what happens to your personal data when you visit this website. Personal data is any data by which you can be personally identified. For detailed information on data protection, please refer to the full privacy policy below this text.

Data collection on this website

Who is responsible for collecting data on this website?

Data processing on this website is carried out by the website operator. You will find the operator’s contact details in section 2 of this privacy policy and in the imprint of this website.

How do we collect your data?

Some data is collected because you provide it to us — for example, when you send us an email.

Other data is collected automatically or with your consent by our IT systems when you visit the website. This is primarily technical data such as your browser, your operating system, or the time the page was accessed. This data is collected automatically as soon as you enter this website.

What do we use your data for?

Part of the data is collected to ensure that the website is provided without errors. Other data is used when you play one of the films embedded on this website.

What rights do you have regarding your data?

You have the right to receive information about the origin, recipients and purpose of your stored personal data free of charge at any time. You also have the right to request that this data be corrected or deleted. If you have given your consent to data processing, you can withdraw that consent at any time with effect for the future. You also have the right to request that the processing of your personal data be restricted under certain circumstances, and you have the right to lodge a complaint with the competent supervisory authority.

For this purpose, and for any further questions about data protection, you may contact us at any time.

This website does not use analytics or advertising tools

This website does not use analytics software, tracking pixels, advertising networks, or profiling of any kind. Your browsing behaviour on this website is not statistically evaluated by us.

2. Controller and general information

Controller

The controller responsible for data processing on this website is:

André Aimaq
Auguststraße 83
10117 Berlin
Germany

Phone: +49 30 28 38 71 90
Email: contact@andreaimaq.com

The controller is the natural or legal person who alone or jointly with others decides on the purposes and means of processing personal data (such as names, email addresses, and similar).

Notes on data protection

The operator of this website takes the protection of your personal data very seriously. We treat your personal data as confidential and in accordance with statutory data protection regulations and this privacy policy.

Please be aware that data transmitted over the internet — for example by email — may have security gaps. Complete protection of data against access by third parties is not possible.

Legal bases of processing

Where we process personal data, we do so on the basis of the following provisions of the General Data Protection Regulation (GDPR):

  • Art. 6(1)(a) GDPR — your consent, for example where you agree to an embedded video being loaded.

  • Art. 6(1)(b) GDPR — the performance of a contract or pre-contractual measures, for example where your enquiry concerns a possible collaboration.

  • Art. 6(1)(f) GDPR — our legitimate interest in a secure, fast and technically error-free provision of this website.

Where consent is required for the storage of or access to information on your device, this is additionally based on § 25(1) TDDDG (German Telecommunications Digital Services Data Protection Act, formerly TTDSG). Consent may be withdrawn at any time.

Storage period

Unless a more specific storage period is stated within this privacy policy, your personal data will remain with us until the purpose for processing no longer applies. If you submit a justified request for deletion or withdraw your consent, your data will be deleted unless we have other legally permissible reasons for storing it — such as statutory retention periods under tax or commercial law. In the latter case, deletion will take place once those reasons no longer apply.

Data transfer to third countries

This website embeds a video player operated by a provider based in the United States (see section 5). When a video is loaded, your personal data — in particular your IP address — may be transferred to servers outside the European Union and processed there. We have no influence over this processing. Such transfers are based on the standard contractual clauses of the European Commission and, where the provider is certified accordingly, on the EU–U.S. Data Privacy Framework.

Please note that the level of data protection in third countries may not correspond to that within the European Union, and that access by local authorities cannot be ruled out.

Withdrawal of your consent

Many data processing operations are only possible with your express consent. You can withdraw consent you have already given at any time. The lawfulness of processing carried out before the withdrawal remains unaffected.

Right to object to the processing of your data (Art. 21 GDPR)

Where data processing is based on Art. 6(1)(e) or (f) GDPR, you have the right to object to the processing of your personal data at any time on grounds relating to your particular situation. The respective legal basis on which processing is based can be found in this privacy policy. If you object, we will no longer process your personal data unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or unless the processing serves the establishment, exercise or defence of legal claims.

If your personal data is processed for the purpose of direct advertising, you have the right to object at any time to the processing of personal data concerning you for the purpose of such advertising. Following such an objection, your personal data will no longer be used for direct advertising purposes.

You can send your objection to the contact details given in section 2.

Right to lodge a complaint with the competent supervisory authority

In the event of infringements of the GDPR, data subjects have the right to lodge a complaint with a supervisory authority, in particular in the Member State of their habitual residence, their place of work, or the place of the alleged infringement. This right is without prejudice to any other administrative or judicial remedy.

The supervisory authority responsible for the controller named above is:

Berliner Beauftragte für Datenschutz und Informationsfreiheit
Alt-Moabit 59–61
10555 Berlin
Germany

Right to data portability

You have the right to have data that we process automatically on the basis of your consent or in performance of a contract handed over to you or to a third party in a common, machine-readable format. If you request the direct transfer of the data to another controller, this will only be done to the extent that it is technically feasible.

Information, correction and deletion

Within the framework of the applicable statutory provisions, you have the right at any time to obtain free information about your stored personal data, its origin and recipients, and the purpose of the data processing, and, where applicable, the right to have this data corrected or deleted. For this purpose, and for any further questions on the subject of personal data, you may contact us at any time.

Right to restriction of processing

You have the right to request the restriction of the processing of your personal data. You can contact us at any time for this purpose. The right to restriction of processing exists in the following cases:

  • If you dispute the accuracy of the personal data we hold about you, we will usually need time to verify this. For the duration of that verification, you have the right to request the restriction of processing.

  • If the processing of your personal data was or is unlawful, you may request the restriction of processing instead of its deletion.

  • If we no longer need your personal data but you require it to exercise, defend or assert legal claims, you have the right to request the restriction of processing instead of deletion.

  • If you have lodged an objection pursuant to Art. 21(1) GDPR, a balance must be struck between your interests and ours. As long as it has not been determined whose interests prevail, you have the right to request the restriction of processing.

If you have restricted the processing of your personal data, this data may — apart from being stored — only be processed with your consent, or for the establishment, exercise or defence of legal claims, or for the protection of the rights of another natural or legal person, or for reasons of important public interest of the European Union or a Member State.

No automated decision-making

We do not use automated decision-making or profiling within the meaning of Art. 22 GDPR.

SSL / TLS encryption

For security reasons and to protect the transmission of confidential content, this site uses SSL or TLS encryption. You can recognise an encrypted connection by the fact that the address bar of your browser shows “https://” instead of “http://” and by the lock symbol in your browser bar. When SSL or TLS encryption is active, the data you transmit to us cannot be read by third parties.

Objection to unsolicited advertising emails

We hereby object to the use of contact data published in the context of our imprint obligation for the purpose of sending unsolicited advertising and information material. The operator of this website expressly reserves the right to take legal action in the event of the unsolicited sending of advertising information, for example by spam email.

3. Hosting

Framer

This website is hosted by an external service provider. The provider is:

Framer B.V., Herengracht 257, 1016 BJ Amsterdam, Netherlands

Framer stores and delivers all content of this website, including the image and video files shown in the portfolio. When you visit this website, Framer processes technical connection data — in particular your IP address, the page requested, the time of the request, the referring page, and information about your browser and operating system — in order to deliver the website and to ensure its security and stability.

The use of Framer is based on Art. 6(1)(f) GDPR. We have a legitimate interest in a reliable, fast and secure presentation of our online portfolio by a professional provider. Where consent has been requested, processing takes place exclusively on the basis of Art. 6(1)(a) GDPR and § 25(1) TDDDG; consent may be withdrawn at any time.

Framer processes this data only to the extent necessary to fulfil its performance obligations and in accordance with our instructions.

Further information: https://www.framer.com/legal/privacy-statement/

Data processing agreement

We have concluded a data processing agreement with Framer as required by Art. 28 GDPR.

Server log files

The hosting provider of this website automatically collects and stores information in so-called server log files, which your browser transmits automatically. These are:

  • browser type and browser version

  • operating system used

  • referrer URL

  • IP address

  • time of the server request

This data is not merged with other data sources and is stored only for a limited period before being deleted or anonymised.

The collection of this data is based on Art. 6(1)(f) GDPR. We have a legitimate interest in the technically error-free presentation of this website and in defending against misuse — for this purpose, server log files must be recorded.

4. Cookies and similar technologies

This website does not set any cookies of its own for analytics, advertising or profiling purposes. We do not use a consent management tool, because no consent-requiring technologies are used in the basic operation of this website.

Cookies and comparable local storage may, however, be set by the embedded video player described in section 5 when a film is loaded or played. These serve to provide the player’s functions, such as remembering playback quality or volume.

Cookies which are necessary to carry out the electronic communication process or to provide functions you have expressly requested are stored on the basis of Art. 6(1)(f) GDPR. Where storage requires your consent, it takes place exclusively on the basis of Art. 6(1)(a) GDPR and § 25(1) TDDDG, and that consent can be withdrawn at any time.

You can configure your browser so that you are informed about the setting of cookies, so that cookies are only permitted in individual cases, so that the acceptance of cookies is excluded for certain cases or in general, and so that cookies are deleted automatically when the browser is closed. If you deactivate cookies, the functionality of the embedded video player may be restricted.

5. Embedded content and external services

Vimeo

The films on this website are embedded by way of the video platform Vimeo. The provider is:

Vimeo.com, Inc., 330 West 34th Street, 5th Floor, New York, New York 10001, USA

When you open a page on which a Vimeo film is embedded, a connection is established to Vimeo’s servers. Vimeo is thereby informed which page of this website you have visited, and receives your IP address. This happens even if you do not start playback. Vimeo may also store cookies or comparable identifiers on your device and record how you interact with the player, for example which film you have watched and for how long.

If you are logged into your Vimeo account at the time of your visit, Vimeo may assign this information to your personal account. You can prevent this by logging out of your Vimeo account before visiting this website.

We have configured the player so that Vimeo’s “Do Not Track” mode is activated. In this mode, according to Vimeo, no tracking cookies are set and no session recordings are created for the purpose of analysing user behaviour. The transmission of your IP address to Vimeo is nevertheless technically necessary in order to deliver the film and cannot be avoided when the player is loaded.

The use of Vimeo serves the attractive presentation of our film work and is in our legitimate interest pursuant to Art. 6(1)(f) GDPR. Where consent has been requested, processing takes place exclusively on the basis of Art. 6(1)(a) GDPR and § 25(1) TDDDG; consent may be withdrawn at any time.

Data transfer to the USA is based on the standard contractual clauses of the European Commission and, where applicable, on Vimeo’s certification under the EU–U.S. Data Privacy Framework.

Further information on the handling of user data can be found in Vimeo’s privacy policy: https://vimeo.com/privacy

Video files hosted on this website

Short preview clips shown in the portfolio overview are not embedded from a third-party platform. They are stored on the servers of our host (see section 3) and are delivered directly from there. No data is transmitted to third parties when these previews are played.

Fonts

For a consistent presentation of typography, this website uses fonts which are delivered from the servers of our host (see section 3). No connection to the servers of a third-party font provider such as Google Fonts is established when you visit this website, and your IP address is therefore not transmitted to such a provider. If your browser does not support the fonts used, a standard font installed on your device will be used instead.

6. Contacting us

Enquiries by email or telephone

This website does not contain a contact form. If you contact us by email or by telephone, your enquiry including all personal data arising from it — such as your name, your company, your email address or telephone number, and the content of your enquiry — will be stored and processed by us for the purpose of handling your request. We do not pass this data on without your consent.

The processing of this data is based on Art. 6(1)(b) GDPR if your enquiry relates to the performance of a contract or is necessary for the implementation of pre-contractual measures. In all other cases, processing is based on your consent (Art. 6(1)(a) GDPR) and/or on our legitimate interest in effectively handling the enquiries addressed to us (Art. 6(1)(f) GDPR).

The data you send us by way of an enquiry will remain with us until you request its deletion, withdraw your consent to its storage, or the purpose for storing the data no longer applies — for example once your enquiry has been dealt with. Mandatory statutory provisions, in particular statutory retention periods, remain unaffected.
